Commission Terms of Service

General Terms

  • Prices are subject to change based on demand.

  • I reserve the right to reject a commission request for any reason.

  • If I accept a commission request, work can take up to 3 months based on factors like commission details or my work schedule.

Commission Process

The commission process consists of two phases -- the Concept Phase and Final Phase, which will proceed as follows:

Concept Phase

  • I will provide you with 2 sketches based on your commission request.  You may approve one of the concepts, or request revised sketches.

  • I will produce up to 3 revised sketches at your direction.  Additional revisions beyond those 3 will be completed at my hourly rate ($75/hour).

  • One you approve a sketch, it becomes the Approved Concept.

Final Phase

  • I will finalize the Approved Concept to the completion level specified in the commission request -- black and white, greyscale, or color.  Once completed, you will be provided a preview for review.

  • You may request changes as long as such requests do not require significant changes from the Approved Concept.  The significance of changes is determined by my professional discretion.  Changes deemed significant will again be completed at my hourly rate.

Payment Terms

  • Payment must be made through PayPal to my account.  Don't make any payments before I've sent a PayPal invoice to you.

  • I require half payment up front to start work on the commission's Concept Phase.

  • The final half payment, plus any additional fees owed, must be paid before I provide access to the completed commission files.

Cancellations & Refunds

  • Both parties have the right to cancel a commission at any time.

  • If cancelled before work is started, a full refund will be issued.

  • Once the concept phase has been started, only half of the down payment will be refunded upon cancellation.  All concept work completed up to that point will be compiled and delivered to you.

  • After I start on the final phase, no refund will be issued.  If for any reason I initiate the cancellation, all work completed up until that point will be compiled and delivered to you.

  • If you are getting a refund, do not request a PayPal chargeback.  I will transfer the money back to you myself.

  • If you request a PayPal chargeback when refunds are not allowed, you will lose all rights to the commissioned artwork and I will gain the right to profit from it in any way.  The chargeback will be denied and I will supply our correspondence to PayPal as proof that I have completed work for you.  Further, you will be blacklisted from commissioning me again.

  • You must provide image references for the commission unless I agree otherwise.

  • If you provide no references, you agree to grant me full creative freedom.  You may still provide critique and request changes as described above.

Delivery of Work

  • After the final payment is received, I will send a link to a Google Drive folder containing the hi-res, flattened artwork in the following file formats:

    • .png, .jpg, .tiff, and .pdf

  • If the work bleeds to the edge of the canvas, print ready files with 0.125" bleed and crop marks will be included.

  • The Google Drive folder will be active for one year, after which the folder and files will be deleted.  Be sure to back up the files before then.

Copyright & Usage

I, the artist:

  • Retain the common-law copyright to all work created in the process of completing the commission.

  • Reserve the right to post the commissioned artwork and any part of its creation process online, in my portfolio, and in publications such as artbooks.

  • Will NOT claim the Intellectual Property (IP) of the commissioned artwork.

You, the client:

  • May upload the commissioned artwork on any website and social channels.

  • May NOT make profits off the commissioned piece.

  • May NOT alter the commissioned piece without my consent.

  • May NOT use the commissioned artwork for commercial purposes.

  • Retain the rights to the intellectual property (IP).

  • May NOT claim the artwork as your own work.

Other conditions:

  • If you break the copyright arrangement and profit off the commissioned artwork, I have the right to claim up to 10% of the profit in royalties.

  • If you wish to use the artwork for commercial purposes, contact me about purchasing a license.

I, the Artist, am not responsible for any damages caused by errors in the finished commission, even if I have been advised of them.
