Commission Terms of Service

General Terms

Prices are subject to change based off demand.

I reserve the right to reject a commission request for any reason.

Payment
-
Payment must be made through PayPal.
-
I require half payment up front to start work on the commission.
-
The final payment must be made before I provide access to the completed files.

Don't make any payments before I've sent a PayPal invoice to you.

References
-
You must provide references for the commission unless I agree otherwise.

If you provides no references, you agree to grant me full creative freedom. Revisions still apply as described below.

Process
-
Upon receiving the down payment and references, I will begin work on the concept phase. I will create up to 5 concept sketches for you. Once you approve a concept, I will start work on the final image.

The timeline to completion can vary anywhere between 1 week - 3 months based off factors such as the commission details or my work schedule.

Revisions
-
You will have the opportunity to critique or request changes to the commission at each stage of the creation process - Concept, Ink, Grey, and Color as applicable.

Once a stage is approved, any change to that stage later will call for an extra charge, decided based off the complexity and time involved.

Delivery
-
After final payment is received, the Artist will send a link to a Google Drive folder containing the hi-res, flattened artwork in the following file formats:

.png, .jpg, .tiff, and .pdf

There will also be a "Print" folder containing the image files with bleed and crop marks.

The Google Drive folder will be active for one year, after which the folder and files will be deleted. Be sure to back up the files before then.

Copyright & Usage
I, the artist:
-
Retain all copyrights over the commissioned artwork.

Reserve the right to post the commissioned artwork and any part of its creation process online, in my portfolio, and in publications such as artbooks.

Will NOT claim the Intellectual Property (IP) of the commissioned artwork.
You, the client:
-
May upload the commissioned artwork on any website and social channels.

May NOT make profits off the commissioned piece.
-
May NOT alter the commissioned piece without my consent.
-
May NOT use the commissioned artwork for commercial purposes.
-
Retain the rights to the intellectual property (IP).
-
May NOT claim the artwork as your own work.
Other conditions:
-
If you break the copyright arrangement and profit off the commissioned artwork, I have the right to claim up to 10% in royalties.

If you wish to use the artwork for commercial purposes, contact me about purchasing a license.

Cancellations & Refunds
-
Both parties have the right to cancel a commission at any time.
-
If cancelled before work is started, a full refund will be issued.

Once the concept phase has been started, only half of the down payment will be refunded upon cancellation.

After the artist starts on the final image, no refund will be issued unless the artist has to cancel, in which case 25% of the down payment will be refunded.

If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.

If you request a PayPal chargeback when refunds are not allowed, you will lose all rights to the commissioned artwork and I will gain the right to profit from it in any way. The chargeback will be denied and I will supply our correspondence to PayPal as proof that I have completed work for you. Further, you will be blacklisted from commissioning me again.
